Lecreuaset Terms of Use
These Terms of Use (“Terms”) govern your access to and use of Lecreuaset’s website (lecreuaset.com, including all subdomains, features, content, and services related to Kitchenware, Cookware, Stoneware, and Wine Accessories) (collectively, the “Platform”). The Platform is owned and operated by Lecreuaset. By accessing or using the Platform—whether to browse products, create an account, or place an order—you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Platform.
1. Eligibility to Use the Platform
To access or use the Platform, you must meet the following requirements:
- Be at least 18 years old (or have the explicit consent of a parent or legal guardian if you are under 18, with such guardian agreeing to be bound by these Terms on your behalf).
- Possess the legal capacity to enter into a binding contract (e.g., not under a legal disability that restricts contractual agreements).
- Provide accurate, current, and complete information when using the Platform (e.g., for account creation, order placement, or customer service inquiries).
- Comply with all applicable local, state, national, and international laws, as well as these Terms.
Lecreuaset reserves the right to deny access to the Platform to anyone at our discretion—including if we reasonably believe you do not meet these eligibility criteria or violate these Terms.
2. Account Creation & Management
2.1 Account Registration
You may choose to create a user account (“Account”) to unlock additional Platform features, such as saving shipping addresses, viewing order history (e.g., past purchases of cookware or stoneware), and tracking current orders. When creating an Account:
- You must provide a valid email address and create a secure password (we recommend a unique combination of letters, numbers, and symbols).
- You agree to keep your Account credentials confidential and not share them with third parties.
- You are solely responsible for all activities conducted under your Account—including purchases, messages sent to customer service, or changes to account details.
2.2 Account Responsibilities & Termination
- If you suspect unauthorized access to your Account (e.g., unknown orders, changed login details), notify us immediately at [email protected] to secure your Account and prevent further issues.
- You may delete your Account at any time by contacting our customer service team at [email protected]. We will process the deletion within 5 business days, though we may retain certain data (e.g., order records for tax compliance) as required by law.
- Lecreuaset may suspend or terminate your Account (and access to the Platform) without prior notice if:
- You violate any provision of these Terms (e.g., engaging in fraudulent activity, sharing misleading product reviews).
- Your Account is inactive for 12 consecutive months (we will send a 30-day notice to your registered email before termination).
- We suspect illegal, abusive, or fraudulent behavior associated with your Account (e.g., using stolen payment methods to purchase stoneware or wine accessories).
Upon Account termination, you will lose access to Account-specific features, but any outstanding obligations (e.g., payment for pending orders, compliance with return policies) will remain in effect.
3. Permitted Uses of the Platform
You may use the Platform only for lawful, non-harmful purposes that align with Lecreuaset’s business and these Terms. Permitted uses include:
- Browsing the Platform to view product information (e.g., details about cookware materials, stoneware care instructions, or wine accessory features).
- Creating and managing an Account to streamline order placement, track deliveries, and save preferences (e.g., favorite kitchenware styles).
- Placing orders for products in accordance with our Terms of Purchase (e.g., providing accurate shipping details, selecting valid payment methods).
- Contacting customer service for assistance with orders, returns, product questions (e.g., “Is this Dutch oven oven-safe?”), or warranty claims.
- Submitting honest, relevant product reviews (if the Platform includes a review feature) that do not contain false information, harassment, or inappropriate content.
4. Prohibited Uses of the Platform
You agree not to use the Platform for any of the following prohibited activities—violations may result in Account termination, legal action, or both:
- Security Breaches: Accessing, modifying, or bypassing the Platform’s security features (e.g., hacking, using automated bots to scrape product data, or attempting to access other users’ Accounts).
- Fraudulent Activity: Using the Platform to deceive or harm others (e.g., placing orders with stolen payment methods, creating fake Accounts to manipulate reviews, or claiming false defects in products to obtain refunds).
- Harmful Content: Uploading, posting, or transmitting content that is illegal, defamatory, harassing, offensive, or infringing (e.g., sharing copyrighted images of cookware without permission, posting reviews that incite violence).
- Disruption of Service: Interfering with the Platform’s operation (e.g., introducing malware, overloading servers with excessive requests, or disrupting user access to product pages).
- Unauthorized Commercial Use: Using the Platform for commercial purposes not approved by Lecreuaset (e.g., reselling product images or descriptions to competitors, using our customer data for marketing unrelated goods).
- Violation of Intellectual Property: Copying, reproducing, distributing, or modifying any of Lecreuaset’s intellectual property (e.g., logos, product designs, website text) without our prior written consent.
5. Intellectual Property Rights
All content and materials on the Platform—including but not limited to product images, descriptions (e.g., “Lecreuaset Non-Stick Ceramic Fry Pan”), logos, trademarks, text, graphics, and software (collectively, “Intellectual Property”)—are owned by Lecreuaset or our licensors. These rights are protected by copyright, trademark, patent, and other applicable laws worldwide.
You are granted a limited, non-exclusive, non-transferable license to access and use the Intellectual Property solely for the purpose of using the Platform as permitted by these Terms. You may not:
- Copy, sell, rent, or distribute any Intellectual Property (e.g., sharing product photos on a competing website).
- Modify or create derivative works based on the Intellectual Property (e.g., altering our logo to use on your own materials).
- Use our trademarks (e.g., “Lecreuaset”) in any way that implies endorsement of your products or services without our written permission.
6. Third-Party Links & Content
The Platform may contain links to third-party websites, services, or content (e.g., payment processors like Stripe, shipping carriers like UPS, or blog posts about kitchen recipes). These links are provided for your convenience only—Lecreuaset does not control, endorse, or assume responsibility for third-party content or services.
Your use of third-party links is subject to the terms and conditions of those third parties. We encourage you to review their privacy policies and terms of use before engaging with them, as Lecreuaset is not liable for any loss or damage resulting from your interaction with third-party platforms.
7. Disclaimer of Warranties
The Platform and all products, content, and services offered through it are provided “as is” and “as available” without any warranties of any kind—express or implied. To the fullest extent permitted by law, Lecreuaset disclaims all warranties, including:
- Implied Warranties: Warranties of merchantability (e.g., that cookware will perform as expected), fitness for a particular purpose (e.g., that stoneware is suitable for oven use), and non-infringement (e.g., that using the Platform will not violate third-party rights).
- Accuracy & Reliability: Warranties that Platform content (e.g., product dimensions, care instructions) is accurate, complete, or up-to-date (we strive for accuracy but do not guarantee it).
- Uninterrupted Use: Warranties that the Platform will be free of errors, downtime, or security breaches (technical issues may occur despite our best efforts).
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
8. Limitation of Liability
To the fullest extent permitted by law, Lecreuaset shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Platform—including but not limited to:
- Loss of profits, data, or business opportunities (e.g., a delay in receiving cookware affecting a catering business).
- Damages from order errors, shipping delays, or product issues (subject to our Terms of Purchase and Refund Policy).
- Harm caused by third-party activities (e.g., payment fraud, unauthorized access to your Account by a hacker).
- Damages from technical failures (e.g., website crashes preventing you from placing an order).
Our total liability to you for any claim related to these Terms or your use of the Platform shall not exceed the total amount you paid to Lecreuaset for products or services in the 12 months prior to the claim.
Some jurisdictions do not allow the limitation of liability for certain damages, so the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Lecreuaset, its affiliates, employees, directors, and licensors from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorney fees) arising from:
- Your use of the Platform or violation of these Terms (e.g., fraudulent order placement, posting infringing content).
- Your breach of any obligations under these Terms (e.g., providing false account information, misusing product reviews).
- Your use of third-party websites or services linked from the Platform.
- Any harm caused to third parties by your actions in connection with the Platform (e.g., a review that defames another user).
10. Changes to These Terms
Lecreuaset may update these Terms periodically to reflect changes in laws, business practices, or Platform features (e.g., adding a new product category like “Eco-Friendly Kitchenware”). When we make changes:
- We will post the revised Terms on the Platform with an updated “Last Modified” date.
- We will notify registered users via email of significant changes (e.g., updates to liability limitations or account termination rules) at least 7 days before the changes take effect.
Your continued use of the Platform after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform immediately.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall first be resolved through good-faith negotiation by contacting our customer service team at [email protected]. If the dispute cannot be resolved within 30 days of initial contact, either party may submit the dispute to binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall be conducted by a single arbitrator, and the arbitrator’s decision shall be final and binding on both parties.
